Terms of Service

SalesWhisperer LTD is a company registered in England and Wales under number 16984196. The company publishes and operates the SalesWhisperer solution, a SaaS application that provides intelligent real-time assistance during sales calls.

The service is intended exclusively for professional use.

SalesWhisperer LTD provides conversation analysis, contextual recommendations and automated summaries based on artificial intelligence technologies. The suggestions generated are for assistance purposes only and constitute neither legal advice nor guaranteed commercial advice.

Access to the service requires the creation of a user account. The user undertakes to provide accurate, complete and up-to-date information.

The user undertakes to use the service in compliance with applicable laws and regulations, in particular those relating to the protection of personal data, the confidentiality of communications and the consent of data subjects.

The user remains solely responsible for obtaining the prior, explicit and informed consent of any person whose voice, statements or personal data are processed through the service.

SalesWhisperer LTD provides the service as is. The company guarantees neither commercial performance nor the absolute accuracy of the analyses or recommendations generated.

SalesWhisperer LTD shall not be held liable for any indirect damage, loss of revenue, loss of data, damage to reputation or disputes resulting from the use of the service.

All intellectual property rights relating to the service, the algorithms, the artificial intelligence models, the interfaces, the content and the brand remain the exclusive property of SalesWhisperer LTD.

The user may terminate their subscription at any time in accordance with the terms available on the platform. Unless otherwise provided, no termination gives entitlement to a refund.

These terms are governed by English law. Where the service is used by persons located in the European Union, the mandatory provisions of European Union law and of the GDPR remain applicable.

The user acknowledges that use of the service involves the processing of communications that may contain personal data of third parties.

The user warrants that they have informed, and obtained the prior and explicit consent of, every data subject before any use of the service.

SalesWhisperer LTD accepts no liability in the event of a lack of consent or non-compliant use.

General principle

SalesWhisperer LTD offers a SaaS service with immediate access. Because of the digital nature of the service and the instant access to its features, no refund is granted by default after subscription.

Trials and limited access

Where SalesWhisperer LTD offers a free trial period or limited access, this trial allows the user to evaluate the service before any financial commitment. Once the trial has ended and the subscription has been activated, the no-refund rules apply.

Exceptional cases of refund

A refund may be considered only in the following cases:

Major technical malfunction making the service completely unusable

Proven billing error attributable to SalesWhisperer LTD

In these cases, the request must be made within a maximum of fourteen (14) days from the invoice date.

Any request must be accompanied by evidence allowing the malfunction to be objectively established (screenshots, technical logs or any equivalent proof).

Refund exclusions

No refund will be granted in the following situations:

Dissatisfaction with commercial performance, sales results or the recommendations generated by artificial intelligence

Partial use or non-use of the service

Incompatibility with the user's technical environment

Absence or lack of consent from the other parties to the calls

Voluntary termination before the end of the subscription period

Cancellation of subscription

The user may cancel their subscription at any time from their customer account. Cancellation takes effect at the end of the current billing period.

No partial or pro rata temporis refund will be made for a period that has already started.

Suspension or termination by SalesWhisperer LTD

SalesWhisperer LTD reserves the right to suspend or terminate an account without refund in the event of a breach of these terms, abusive use of the service or failure to comply with applicable laws.

In operating the service, SalesWhisperer LTD uses the following technical subprocessors:

Anthropic (Claude): artificial intelligence model services

Soniox: transcription and audio processing

Deepgram: transcription and audio processing

Supabase: database and authentication infrastructure

Stripe: payment processing

Brevo: transactional and informational emails

These subprocessors act solely on the instructions of SalesWhisperer LTD and provide sufficient guarantees with regard to security and the protection of personal data.
