SalesWhisperer LTD is a company registered in England and Wales under number 16984196. The company publishes and operates the SalesWhisperer solution, a real-time intelligent assistance SaaS software for sales calls.

The service is exclusively intended for professional use.

Service description

SalesWhisperer LTD provides conversational analytics, contextual recommendations, and automated summaries based on artificial intelligence technologies. The generated suggestions are for assistance purposes only and do not constitute legal advice or guaranteed business advice.

Access and use

Access to the service requires the creation of a user account. The user agrees to provide accurate, complete, and up-to-date information.

The user agrees to use the service in accordance with applicable laws and regulations, particularly regarding personal data protection, communication privacy, and consent from relevant individuals.

The user remains solely responsible for obtaining the prior, explicit, and informed consent of any person whose voice, statements, or personal data are processed through the service.

Responsibility

SalesWhisperer LTD provides the service as is. The company does not guarantee commercial performance, nor the absolute accuracy of the analyses or recommendations generated.

SalesWhisperer LTD shall not be liable for indirect damages, loss of revenue, loss of data, damage to reputation or disputes arising from the use of the service.

Intellectual property

All intellectual property rights related to the service, algorithms, artificial intelligence models, interfaces, content, and brand remain the exclusive property of SalesWhisperer LTD.

Termination

The user can terminate their subscription at any time according to the terms available on the platform. Unless stated otherwise, no termination gives the right to a refund.

Applicable law

These terms are governed by English law. When the service is used by individuals located in the European Union, the mandatory provisions of European Union law and the GDPR remain applicable.

Consent Policy

The user acknowledges that the use of the service involves the processing of communications that may contain personal data of third parties.

The user guarantees that they have informed and obtained the prior and explicit consent of any concerned individuals before any use of the service.

SalesWhisperer LTD disclaims any liability in the event of lack of consent or non-compliant use.

Refund and Cancellation Policy

General principle


SalesWhisperer LTD offers an immediate access SaaS service. Due to the digital nature of the service and instant access to features, no refunds are granted by default after subscription.


Trials and limited access


When SalesWhisperer LTD offers a free trial period or limited access, this trial allows the user to evaluate the service before any financial commitment. Once the trial is over and the subscription is activated, the no-refund policy applies.


Exceptional refund cases


A refund may be considered only in the following cases:

  • Major technical malfunction rendering the service completely unusable

  • Proven billing error attributable to SalesWhisperer LTD

In these cases, the request must be made within a maximum of fourteen (14) days from the billing date.

Any request must be accompanied by elements that objectively demonstrate the malfunction (screenshots, technical logs, or any equivalent proof).


Refund exclusions


No refund will be granted in the following situations:

  • Dissatisfaction related to business performance, sales results, or recommendations generated by artificial intelligence

  • Partial use or non-use of the service

  • Lack of compatibility with the user's technical environment

  • Absence or failure of consent from participants during calls

  • Voluntary termination before the end of the subscription period


Subscription cancellation


The user can cancel their subscription at any time from their client area. The cancellation takes effect at the end of the current billing period.

No partial refund or prorated refund will be made for a period already started.

Suspension or termination by SalesWhisperer LTD

SalesWhisperer LTD reserves the right to suspend or terminate an account without refund in case of violation of these terms, abusive use of the service, or failure to comply with applicable laws.

Technical subcontractors

As part of the operation of the service, SalesWhisperer LTD engages the following technical subcontractors:

OpenAI – artificial intelligence model services

Deepgram – transcription and audio processing

Supabase – database infrastructure and authentication

Stripe – payment processing

These subcontractors act exclusively on the instructions of SalesWhisperer LTD and provide sufficient guarantees regarding security and the protection of personal data.
